Terms of Service

You must be at least 18 years of age to create an account and use the Platform independently. Users between 13 and 18 years of age may use the Platform only with verifiable parental or guardian consent. We reserve the right to terminate accounts where this requirement is not met.

You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.

Each individual may maintain only one active account. Creating multiple accounts to circumvent restrictions, bans, or platform limits is prohibited and will result in termination of all associated accounts.

If you register on behalf of a business or legal entity, you represent that you have the authority to bind that entity to these Terms, and "you" refers to both the individual and the entity.

The Platform offers a free Standard Plan and a paid Premium Plan. Plan features, limits, and pricing are described on the pricing page and may be updated with 30 days' advance notice to existing subscribers.

Premium subscriptions are billed on a recurring basis (monthly or annually) through our payment processors (Razorpay for INR transactions; Stripe for international). Subscriptions auto-renew unless cancelled before the renewal date. Prices are inclusive of applicable taxes (GST at 18%) where displayed in INR.

Subscription fees are non-refundable except as required by applicable law or where the Platform is materially non-functional for more than 72 continuous hours. Cancellation takes effect at the end of the current billing period; you retain Premium access until then. Refunds for technical failures may be requested within 7 days at billing@originalcollectors.com.

If your account is suspended or terminated for violation of these Terms or our Community Guidelines, no refund of subscription fees will be provided.

You retain all intellectual property rights in the content you create and upload to the Platform ("User Content"), including photographs, descriptions, posts, and vault listings. By uploading User Content, you grant Original Collectors a non-exclusive, royalty-free, worldwide, sublicensable licence to host, store, display, reproduce, and distribute your content solely for the purpose of operating and improving the Platform.

You represent and warrant that: (a) you own or have the right to use all User Content you upload; (b) your User Content does not infringe any third-party intellectual property rights; (c) your User Content complies with our Community Guidelines and all applicable laws.

You must not upload or share:

• Content that is defamatory, obscene, hateful, or incites violence
• Content that infringes copyright, trademark, or other intellectual property rights
• Misleading or fraudulent descriptions of items (including counterfeit items presented as originals)
• Personally identifiable information of others without their consent
• Spam, malware, phishing links, or any content designed to deceive or harm
• Content that violates the IT Act 2000 or any other applicable Indian law

All Platform content, design, code, trademarks, logos, and brand elements are the exclusive property of Original Collectors or its licensors. Nothing in these Terms grants you a right to use our intellectual property without prior written consent.

Any feedback, suggestions, or ideas you submit to us may be used by us without any obligation to compensate you, and without restriction.

The Marketplace is a tool for listing and discovering items. Original Collectors is not a party to any transaction, does not act as buyer, seller, agent, broker, or auctioneer, and does not hold any funds on behalf of either party.

Sellers are responsible for: accurate item descriptions and photographs; lawful ownership of items listed; timely communication with interested buyers; and compliance with applicable tax obligations (including GST where applicable) on their sales.

Buyers are responsible for verifying item authenticity, condition, and seller credibility before transacting. The Platform provides transaction coordination tools and a dispute reporting mechanism, but resolution of payment disputes is the sole responsibility of the parties.

You must not list: stolen goods; counterfeit items; items subject to import/export restrictions under Indian law; or items prohibited under the Consumer Protection Act, 2019. We reserve the right to remove any listing at our sole discretion.

Auction features, when enabled, operate under the same off-platform payment principles. Bid commitments are binding moral obligations between parties; they are not legally enforceable payment commitments through Original Collectors.

We reserve the right, at our sole discretion and without prior notice, to: remove or modify any User Content that violates these Terms or our Community Guidelines; restrict, suspend, or permanently terminate any account; and take any other action we deem necessary to protect the Platform or its users.

Our standard moderation approach follows a graduated escalation: (1) warning, (2) temporary feature restriction, (3) temporary account suspension, (4) permanent account termination. We reserve the right to bypass earlier steps for serious violations.

You may appeal moderation actions within 30 days by contacting safety@originalcollectors.com. We will acknowledge your appeal within 48 hours and provide a decision within 7 business days. Our decision on permanent account terminations is final after one successful appeal review.

We are an intermediary under the IT Act 2000 and act in good faith on credible reports of violations. We will respond to valid takedown requests from competent Indian authorities within the statutory timeframes.

Nothing on the Platform constitutes financial, investment, insurance, legal, or professional advice of any kind. Item valuations, Growth Index scores, and AI-generated descriptions are for informational and entertainment purposes only and should not be relied upon for any financial decision. We expressly disclaim liability for any loss arising from reliance on Platform content.

We do not guarantee that the Platform will be available continuously, without interruption, or free from errors. We may suspend the Platform for maintenance without liability.

We are not liable for the conduct of any User, buyer, seller, or community member. We are not liable for any transaction, payment, or dispute between Users. We are not liable for losses arising from reliance on AI-generated content, partner product recommendations, or affiliate links.

To the maximum extent permitted by applicable law, Original Collectors' aggregate liability to you for any claim arising from or related to the Platform is limited to the greater of: (a) the total subscription fees paid by you to us in the 3 months preceding the claim, or (b) INR 500 (Indian Rupees Five Hundred).

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunities, even if advised of the possibility of such damages.

You may close your account at any time from your Settings page. Upon closure, your personal data will be processed per our Privacy Policy (right to erasure). Your public posts and community contributions may be anonymised rather than deleted, to preserve community integrity.

We may terminate or suspend your account immediately, without prior notice or liability, if you breach these Terms. On termination, your right to use the Platform ceases immediately.

Clauses 5 (Content), 6 (Marketplace), 9 (Disclaimers), 12 (Governing Law), and 13 (Disputes) survive any termination of these Terms.

Before filing any formal legal action, you agree to first contact us at legal@originalcollectors.com and attempt to resolve the dispute informally within 30 days.

Nothing in these Terms prevents you from filing a complaint with the National Consumer Disputes Redressal Commission (NCDRC) or appropriate State Consumer Disputes Redressal Commission under the Consumer Protection Act, 2019.
